Sitka seiners fined, forfeit $6,500 worth of salmon

Location: Sitka
Type: Update — commercial fish closed waters
On 7/18/11 Alaska Wildlife Troopers, Sitka Post, observed the F/V Wendy Anne operating commercial seine gear near False Island. The area was not open to commercial purse seining. Permit holder Todd M. Nevers and owner-operator Todd L. Bayne, both of Sitka, were cited for commercial fishing in closed waters, and 13,536 pounds of salmon were seized. On 7/26/11 both Nevers and Bayne pled no contest to commercial seining during a closed period. Nevers was fined $6,000 with $3,000 suspended, and he was placed on probation for two years. Bayne was fined $3,000 with $1,500 suspended and placed on probation for one year. The illegally taken fish, valued at approximately $6,500, were forfeited to the state.

Assistance rendered, July 19 — Complainant reported that one of his crew mates had not shown up to the airport with the rest of the crew. Individual was eventually located.

Welfare check, July 19 — Caller requested officers conduct a welfare check on a friend that called her in a drunken state late last night, reporting he was missing half of his nose and near high voltage wires. Contact with the individual resulted in the discovery that he had a rough night, but did not need medical attention.

Welfare check, July 21 — An out-of-town judge reported a plaintiff in a case threatened suicide and to kill an attorney in Anchorage, presumably not in that order. Officers contacted the individual who stated he had lost his temper and it would not happen again, as he had discovered how important it was to take his medication.

Troopers ticket five Cook Inlet salmon setnetters

On 7/16/11 while on routine helicopter patrol of the Cook Inlet commercial fishery, Alaska Wildlife Troopers observed a setnet fishing after the period closed. Troopers contacted Robert V. Williams, 50, of Kasilof, and issued a summons to appear in court on 8/19/11.

Crew accused of fishing illegally, hiding boat ID

Type: Commercial fish closed waters, hindering prosecution
On 7/17/11 at about 1536 hours, King Salmon Wildlife Troopers on aircraft patrol of the commercial fishery in the Naknek section observed a drift gillnet vessel fishing in closed waters. As troopers attempted to document its identity, two crewmen moved to the sides of the vessel and intentionally pulled up and positioned several bumper buoys to obstruct the vessel's Alaska Department of Fish and Game numbers from view. After some time, the boat was identified as the F/V Richie A. Troopers aboard the P/V Woldstad made contact with the vessel but were unable to board due to rough seas and ordered it to shore. At 1834 hours the F/V Richie A was contacted in Naknek and the skipper identified as Richard R. Aiello, 42, of Monterey, Calif. The crewmen who obstructed the investigation were identified as Manual L. Amorin, 39, also of Monterey, and Aiello's 16-year-old son. Aiello was issued mandatory court citations for commercial fishing in closed waters, contributing to the delinquency of a minor and commercial fishing with obscured ADF&G numbers. Amorin was cited into court on one count of hindering prosecution. The juvenile was not charged. Arraignment on all charges set for 7/21/11 in Naknek District Court.

On 7/19/11 James A. Parker, 56, of Everett, Wash., was cited by Bristol Bay Wildlife Troopers for commercial fishing in closed waters outside the Egegik District. Arraignment scheduled for 7/22/11 in Naknek District Court.

Gillnetter nets $3,000 fine, forfeits value of catch

On 7/21/11 Ronald L. Martin, 69, of Haines, pled no contest in Juneau District Court to one count of commercial fishing during a closed period. Martin was fined $5,000 with $2,000 suspended and ordered to forfeit the $1,400 value of the illegally taken fish. Martin was placed on probation for two years. The case originated when Juneau Wildlife Troopers contacted Martin fishing during a closed period near Point Bridget north of Juneau.

Coast Guard terminates voyage of fishing vessel near St. Paul

KODIAK — The Coast Guard cutter Rush terminated the voyage of the 32-foot St. Paul-based commercial fishing vessel Nina Matrona II for a safety violation during a boarding Wednesday three miles northeast of St. Paul Island.

A boarding team found the vessel master operating without any firefighting equipment. The Coast Guard requires commercial fishing vessels between 26 feet and 40 feet to have two fire extinguishers.

The Nina Matrona II, a longliner, was fishing for halibut at the time of the boarding.

The Rush escorted the boat to St. Paul Island after the boarding was completed.

The crew of the Rush also boarded four other vessels in the vicinity of St. Paul Island.

The 378-foot Rush is a high-endurance cutter based out of Honolulu. It was launched in New Orleans in 1968 and is named after Richard Rush, a former treasury secretary.

On 7/19/11 James Jensen Jr., 58, of Cordova, was cited by the Valdez Wildlife Trooper for commercial fishing within 500 yards of a salmon stream in Port Valdez on 7/17/11. Arraignment scheduled for 9/22/11 in Valdez District Court.

On 7/17/11 Louis Beaudry, 83, of Idaho, was cited by the Valdez Wildlife Trooper for commercial fishing within the closed waters of a salmon stream, in Anderson Bay. Arraignment scheduled for 8/25/11 in Valdez District Court.

Dutch Harbor report

Assistance rendered, July 11 — Complainant came to Public Safety with a fellow crew member who was suffering from paranoia.

Ambulance request, July 11 — Caller requested EMS for a crew member who may be experiencing a heart attack aboard a fishing vessel.

Suspicious person, July 12 — Caller reported there was a guy acting crazy in the middle of Ballyhoo Road in front of the old Alaska Ship Supply.

Assault, July 13 — Caller reported he was having a disagreement with three to five men off the F/V Ocean Alaska at the Spit Dock which escalated in one of the men pulling a knife from his belt. Several subjects were contacted by officers, all of whom had varying descriptions of what had occurred. No charges were filed.

Animal, July 13 — Caller reported to Public Safety that several people were feeding the eagles on East Broadway, just across the street from Kelty Field. For that reason, the eagles were not moving out of the way of oncoming vehicles, impeding traffic by staying on the roadway and making it difficult for pedestrians to safely walk their dogs. Officer responded and cleared the area.

Suspicious activity, July 13 — A person who just came from Captains Bay Road reported a suspicious "red skiff" floating in the bay. Officers responded and determined an intoxicated individual had passed out in the skiff and went adrift. A friend responded to assist in another skiff. While crossing over to a second skiff the intoxicated individual fell into the water but was eventually pulled into the skiff by his friend.

Ambulance Request, July 13 — Officer requested EMS for a man who fell into the bay while attempting to get back onto shore.

Suspicious activity, July 13 — Caller reported hearing what seemed like a seal bomb or gunfire coming from the bay area. Officers investigated and were unable to locate persons in the area.

Drunken disturbance, July 16, 0149 hours — Individual called 911 and requested officer assistance at the Harbor View bar. Report that someone had thrown a bottle at the glass window near the dance floor. The window did not break but the bottle shattered upon impact.

Trespass, July 16, 0209 hours — On behalf of UniSea, the drunken individual who tried to play baseball with a bottle and hit the glass window was trespassed from all UniSea hospitality locations for three months.

Assault, July 16, 0254 hours — Caller reported several men fighting behind the UniSea Mall. No charges were filed.

Trespass, July 16, 0343 hours — On behalf of UniSea, individual female was trespassed from all UniSea bunkhouses and UniSea Inn permanently.

Trespass, July 16, 1645 hours — On behalf of UniSea, a male individual was trespassed from both the Cape Cheerful Lounge and the Harbor View bar due to his disruptive and aggressive behavior.

Ambulance request, July 16 — Caller reported a passenger on PenAir flight 7303 partially cut off a portion of his/her finger while possibly maneuvering the arm rest. Patient was safely taken to the clinic for treatment.

Lack of halibut permit costs Metlakatla man $3K

On 6/28/11 Jay Beal, 32, of Metlakatla, pled no contest to fishing for halibut in Alaska state waters without a Commercial Fisheries Entry Commission permit. Beal was fined $3,000 and placed on probation for two years. Beal originally was cited by Alaska Wildlife Troopers, Ketchikan Post, after he was contacted in June commercial fishing outside Annette Island waters.

Arrest warrants issued for 2 Bristol Bay fishermen

On 6/28/11 Nicholas N. Basargin, of Plamondon, Alberta, and Alexey E. Basargin, of Homer, both were cited for two counts of commercial fishing during a closed period in the Nushagak District. Nicholas Basargin was the skipper and Alexey Basargin was the permit holder onboard the F/V Baikal when the violations were committed. On 7/12/11 both defendants failed to appear for their arraignments in Dillingham District Court. The court issued $1,000 bench warrants for their arrest.

He was fined $3,000 with $2,000 suspended and placed on probation for a period of two years under conditions of committing no other commercial fishing violations.

On 7/12/11 Thomas L. Hoseth, 59, of Dillingham, pled guilty in Dillingham District Court to one charge of commercial fishing in a closed period. He was fined $3,000 with $1,500 suspended, ordered to forfeit 483 pounds of fish seized during the investigation, and placed on probation for a period of two years under conditions of committing no other commercial fishing violations.

On 7/12/11 David B. Zielinski, 47, of Seattle, pled guilty in Dillingham District Court to one charge of commercial fishing in closed waters. He was fined $6,000 with $4,000 suspended and placed on probation for a period of two years under conditions of committing no other commercial fishing offenses. The charge against Karl L. Nelson, who was a co-defendant in the case, was dismissed as part of the resolution.

He was fined $3,000 with $1,500 suspended, and 216 pounds of fish seized during the investigation were forfeited to the state. Kelley also was placed on probation for a period of two years under conditions of committing no other commercial fishing violations.

Hoonah crabber fined $1,500 after no contest plea

On 7/6/11 William Veler, 49, of Hoonah, was cited by Alaska Wildlife Troopers, Ketchikan Post, for commercial fishing in closed waters and for unlawful storage of Tanner crab gear. Veler was cited after the patrol vessel Enforcer located nine commercial Tanner crab pots in fishing condition in closed waters. On 7/6/11 Veler appeared in Hoonah District Court and pled no contest to commercial fishing in closed waters. He was fined $3,000 with $1,500 suspended.

Seiner fished at Hoonah after closure, troopers say

On 7/12/11 Bryan Howey, 43, of Sitka, was cited by Hoonah Wildlife Troopers for commercial purse seine fishing in closed waters. At 5:04 p.m. troopers contacted Howey, who was towing his seine and fishing just off Hawk Inlet. Howey, the skipper onboard, apparently was unaware that the purse seine fishery on the Hawk Inlet shoreline closed at 5 p.m. Arraignment set for 7/20/11 in Hoonah District Court.

Sitka salmon troller, crewman net fines, probation

On 7/12/11 Patrick Barker pled guilty in Sitka District Court to one count each of commercial fishing in closed waters, retaining undersized king salmon and possessing commercial fish without a valid permit card in possession. Barker was fined a total of $4,250 with $2,500 suspended, ordered to pay $255.80 in restitution for illegally taken fish, and placed on probation for one year. The undersized fish were forfeited. Carl Heckman, as the crewmember on the vessel, pled guilty to one count of commercial fishing in closed waters and was fined $1,500 with $1,000 suspended. He also was placed on probation for one year.

Assault, July 6 — Ignacio L. Murillo, 49, of Unalaska, was arrested for assault after he attempted to choke a UniSea coworker who had allegedly teased him.

Disorderly conduct, July 7, 0219 hours — Officers intervened in a scuffle in front of the Harbor View bar, where two men were attempting to calm a very intoxicated and distraught third man. The first two men told the officer they intended to take the third back to his vessel.

Suspicious activity, July 7 — UniSea security reported having received an anonymous letter alleging that an employee had been sexually assaulted by another employee, who was also selling illicit drugs. No information to substantiate these claims was provided.

Ambulance request, July 9 — EMS provided medical care to an individual who had suffered a seizure while out at sea.

Assistance rendered, July 10, 0239 hours — Taxi driver reported an intoxicated male who would not get out of her cab once the destination was reached. Officers discovered the man had soiled himself and was not actually at the dock where his vessel was located. Officers assisted him to the appropriate location and found a sober third party to care for him the remainder of the night.

On 7/2/11 at approximately 2040 hours, Alaska Wildlife Troopers from the Cordova Post received a report that Keith Edens, 21, of Homer, had deployed a drift gillnet in the Eshamy District then left the area, abandoning the net. Investigation revealed that Edens was operating a gillnet in waters closed to commercial fishing and not immediately supervising the operation of the net. A summons was issued to appear on 8/31/11 in Cordova District Court for arraignment.

Bristol Bay fisherman charged with assaulting crew

On 7/6/11 at 0553 hours, Alaska State Troopers were notified of an assault that occurred on the F/V Red Hook 2 in Bristol Bay near Johnson Hill. Troopers met the boat as it pulled up to the Peter Pan dock in Naknek. Investigation revealed that Peter Sommerness, 33, of Marysville, Wash., had assaulted two crewmembers on the boat while they were fishing this morning. Sommerness was arrested on two counts of domestic violence assault and was transported to the King Salmon jail.

Hit and run reported on Egegik River

On 7/5/11 at approximately 0300 hours, Terry Ostling, 39, of Cathlamet, Wash., had his fishing vessel anchored in the Egegik River. Ostling and his crew were sleeping down below when another fishing vessel hit them head-on in the dense fog. The collision caused substantial damage to the bow and snapped the anchor chain. Due to the dense fog, Ostling was unable to identify the boat that hit them. The second boat did not stop. Damage to Ostling's boat was estimated at $2,000. Anyone with information on the second boat involved in this collision is asked to call the Alaska State Troopers in King Salmon.

Welfare check, June 27, 1750 hours — A 911 hang-up call was received from a phone somewhere in the UniSea complex. The origin of the call could not be determined.

Assistance rendered, June 27 — Caller, frustrated with his inability to get a flight out of town, phoned 911 and requested police assistance getting a seat on a departing flight. Police were able to determine the caller in fact already had a confirmed seat, on a later flight.

Environmental, June 28 — A fuel spill was observed near the Spit Dock. Information passed on to the Ports Department.

Disorderly conduct, June 28, 2147 hours — An argument about the use of phone card minutes escalated into a shoving match onboard a fishing vessel. An officer advised the aggressor, per the ship's captain, to leave the vessel.

Trespass, June 28, 2324 hours — A permanent trespass advisement was issued to a crewman who was no longer welcome onboard a fishing vessel.

Animal, June 29 — Caller reported two men throwing rocks at the eagle's nest in the Dutch Harbor post office parking lot. The men denied doing so, and said they had simply been flapping their hands at the eagles in an attempt to make them fly.

Animal, June 30 — Dead eagle.

Burglary, July 1 — Dispatcher received a call from a man in Jamaica reporting that drunken people in Unalaska were attempting to burglarize the bunkhouse in which a friend was living. After determining which bunkhouse was the target, officers responded and indeed found two drunken men who admitted they had tried to gain entry to the locked bunkhouse. The men had recently been fired by their employer and owner of said bunkhouse. Both men were subsequently advised to leave the area. No charges were filed.

Assault, July 1, 1253 hours — One inebriate pummeled another in a corridor at the Harbor View Inn before the brawl spilt out the door and into the roadway. Wainy Ruben, 29, of Micronesia, was arrested for assault after both he and his victim had been treated for their injuries.

Ambulance request, July 1, 1254 hours — EMS personnel provided care and transport to two drunks with injuries sustained in a brawl.

Assault, July 1 — Bunkhouse resident #1 reported being threatened by bunkhouse resident #2, who was annoyed about #1 having exposed #2's keeping of a puppy, a clear violation of bunkhouse rules. Officers told both men to cease contact with one another.

Trespass, July 2 — Officer issued a trespass advisement, per Trident management, to a drunken former employee who was no longer welcome anywhere near Trident's business property.

Welfare check, July 2, 0224 hours — Caller reported an intoxicated fisherman was having difficulty boarding his vessel, and was concerned that he might fall into the water. Officers responded and found that the man had successfully gained access to his boat.

Animal, July 2 — Caller reported several bald eagles circling over the carcass of another bald eagle. An officer collected the eagle for shipment to the U.S. Fish and Wildlife Service.

Suspicious activity, July 3, 0401 hours — Noise complaint at the UniSea Inn. Officers located 14 men partying inside the room and assisted UniSea security in removing the many loud and unwanted guests.

Welfare check, July 3, 0431 hours — Officer contacted an inebriated bicycle rider, who insisted on cycling on in spite of his intoxication because the exercise was good for a strong and healthy body.

Troubles mount for jailed Petersburg crabber

On 7/2/11 James R. Seymour, 35, of Petersburg, was charged with one count of commercial king crabbing in a closed season and one count of operating illegal gear. Seymour was served the summons at the Lemon Creek Correctional Center in Juneau after he had been arrested earlier in the day for failing to appear in court regarding charges of illegally storing commercial crab gear. In addition to the most current charges, Seymour has five prior convictions since 2008 for commercial crab violations.

In addition, a charge of tampering with evidence involving the case is being forwarded to the district attorney. Arraignment scheduled for 7/13/11 in Naknek District Court.

On 7/2/11 at 1045 hours, Alaska Wildlife Troopers in Juneau arrested James R. Seymour, 35, of Petersburg, for failing to appear for a 6/30/11 court appearance on an original charge of illegal storage of commercial crab gear. Seymour was remanded to the Lemon Creek Correctional Center with a $4,000 bail.

Troopers: Dillingham skipper fished during closure

On 6/27/11 Katherine R. Carscallen, 25, of Dillingham, was cited by Dillingham Wildlife Troopers for operating a commercial drift gillnet during a closed period in the Nushagak District as skipper and permit holder onboard the F/V Sea Hawk. She also was cited for failure to have a triangle plate permanently attached to the vessel as required. Arraignment is schedule for 7/19/11 in Dillingham District Court.

Kake troller charged with fishing in closed area

On 6/28/11 Alaska Wildlife Troopers, Ketchikan Post, cited Nicholas Davis, 64, of Kake, for commercial fishing by power troll in a closed area on the F/V Joy. A mandatory court appearance was set for 7/19/11 in Kake District Court.

Cordova gillnetter accused of fishing during closure

On 6/28/11 Timothy E. Dillon, 59, of Cordova, operator and permit holder on the F/V Smoky Point, was cited by the Alaska Wildlife Troopers, Cordova Post, for operating a drift gillnet during a closed period. Arraignment was set for 8/17/11 in Cordova District Court.

Two fishermen cited on lower Yukon

On 6/29/11, during a commercial fishery patrol via state float plane, Alaska Wildlife Troopers from St. Marys cited permit holder Robert Moore, 51, of Emmonak, for commercial fishing during a closed period. Troopers also cited permit holder John Crane, 32, of Emmonak, for commercial fishing during a closed period.

Trooper out of Valdez tickets two fishermen

On 6/24/11 Feodosia Reutov, 33, of Molalla, Ore., was cited by the Valdez Wildlife Trooper for commercial fishing in the closed waters of an anadromous stream on the north end of the Eshamy District. Reutov was issued a second citation for unlawful possession of illegally taken fish. Arraignment scheduled for 7/27/11 in Cordova District Court.

On 6/21/11 Koal Backlund, 20, of Seward, was cited by the Valdez Wildlife Trooper for operating a commercial drift gillnet too close to a set gillnet, in Falls Bay. Backlund set his driftnet, then anchored his boat and went to sleep. The driftnet drifted into a setnet, becoming entangled. Arraignment scheduled for 7/27/11 in Cordova District Court.
