Several federal enforcement actions settled

NOAA's Office of General Counsel reports the following resolved cases charged before May 1 of this year:

ALASKA

• F/V Northern Victor — Owner Westward Seafoods Inc. and manager Jacob L. Courson were charged jointly and severally under the Magnuson-Stevens Fishery Conservation and Management Act with failing to timely submit three product transfer reports. A $2,250 NOVA (notice of violation and assessment) was issued. The case against the owner settled for $2,025. The case against the operator defaulted.

• Silver Bay Seafoods-Kodiak LLC — Silver Bay Seafoods-Kodiak LLC, a shoreside processor, was charged under the Magnuson-Stevens Act for utilizing a scale to weigh groundfish that failed to display a valid state of Alaska sticker indicating that the scale was inspected and approved within the previous 12 months. A $21,000 NOVA was issued, and the case settled for $16,800.

• F/V Aleutian Beauty — Operator William Edmund Widing and owners Widing Aleutian Beauty LLC and Peter Thompson were charged jointly and severally under the Magnuson-Stevens Act with failing to comply with vessel monitoring system requirements on eight trips. A $32,000 NOVA was issued, and the case settled for $16,000.

WEST COAST

• F/V Majesty — Owner Trident Seafoods Corp. and operator Tony Jones were charged jointly and severally under the Magnuson-Stevens Act with failing to comply with the terms of a NMFS-accepted electronic monitoring vessel monitoring plan. A $152,000 NOVA was issued, and the case settled for $120,000.

Vessel owner-operator hit with nearly $20K penalty

NOAA's Office of General Counsel reports this case charged in May:

• F/V Sentinel — Owner-operator Arseny I. Polushkin was charged under the Magnuson-Stevens Fishery Conservation and Management Act with fishing for groundfish in the Gulf of Alaska without a federal fisheries permit, failing to log a groundfish fishing trip in the Observer Deploy and Declare System, and interfering with, obstructing and delaying an authorized officer in conducting an investigation, search and seizure. Proceeds of $8,998.30 were previously judicially forfeited. A $19,750 NOVA (notice of violation and assessment) was issued.
