Two sentenced in Bristol Bay illegal fishing case

Here's an update to a case we first reported here.

Type: Update — commercial fish closed waters, hindering prosecution
On 8/17/11 in Naknek District Court, Richard Aiello pled guilty to a consolidated strict liability violation for commercial fishing in closed waters. He was sentenced to pay a $5,000 fine with none suspended, and he will receive six demerit points against his Commercial Fisheries Entry Commission permit. A charge of contributing to the delinquency of a minor was dismissed as part of an agreement. Manual Amorin pled guilty to one count of hindering prosecution and received a $500 fine.

Crew accused of fishing illegally, hiding boat ID

On 7/17/11 at about 1536 hours, King Salmon Wildlife Troopers on aircraft patrol of the commercial fishery in the Naknek section observed a drift gillnet vessel fishing in closed waters. As troopers attempted to document its identity, two crewmen moved to the sides of the vessel and intentionally pulled up and positioned several bumper buoys to obstruct the vessel's Alaska Department of Fish and Game numbers from view. After some time, the boat was identified as the F/V Richie A. Troopers aboard the P/V Woldstad made contact with the vessel but were unable to board due to rough seas and ordered it to shore. At 1834 hours the F/V Richie A was contacted in Naknek and the skipper identified as Richard R. Aiello, 42, of Monterey, Calif. The crewmen who obstructed the investigation were identified as Manual L. Amorin, 39, also of Monterey, and Aiello's 16-year-old son. Aiello was issued mandatory court citations for commercial fishing in closed waters, contributing to the delinquency of a minor and commercial fishing with obscured ADF&G numbers. Amorin was cited into court on one count of hindering prosecution. The juvenile was not charged. Arraignment on all charges set for 7/21/11 in Naknek District Court.

On 7/19/11 James A. Parker, 56, of Everett, Wash., was cited by Bristol Bay Wildlife Troopers for commercial fishing in closed waters outside the Egegik District. Arraignment scheduled for 7/22/11 in Naknek District Court.

Troopers escort Bristol Bay gillnetter to port, seize nets and catch after attempts to hide vessel ID

Type: Commercial fish closed waters, hindering prosecution
On 6/27/11 at 1215 hours, Bristol Bay Wildlife Troopers on aircraft patrol observed a drift gillnet vessel commercial fishing in closed waters outside the open Naknek section. As the aircraft circled to identify the vessel, the skipper, later identified as Steven D. Lewis, 60, of Anchorage, used his body to obscure the vessel's Alaska Department of Fish and Game numbers from view while the crew pulled the net from the water. As the aircraft continued to circle, two crewmen, later identified as Tobbie J. Cook, 55, of Petersburg, and Cody W. Dishon, 22, of Palmer, stood on each rail of the boat and used their bodies to obscure the vessel's ADF&G numbers from view of the AWT aircraft. The pilot was eventually able to observe the vessel's name as the F/V Steinbit. The crew was observed to stand, blocking the ADF&G numbers for approximately 55 minutes until the arrival of an AWT patrol skiff. The vessel subsequently was escorted to Naknek where the vessel's nets and illegal catch of 3,000 pounds of salmon were seized. Lewis was cited for commercial fishing in closed waters and also for commercial fishing with obscured ADF&G numbers. The two crewmen were each issued mandatory court citations for hindering prosecution in the second degree. Arraignment on all charges is set for 7/15/11 in Naknek District Court.

Fines dealt at Naknek in hide-the-numbers case

Type: Update — illegal fishing, hindering prosecution
On 5/3/11 in Naknek District Court, Tim Allen Vardy, 55, and Linda Sue Vardy, 47, both of Lakewood, Wash., accepted plea agreements with the state. Tim Vardy pled guilty to a single count of hindering prosecution and was fined $2,000 with none suspended. He was also placed on probation for one year. All other charges were dismissed. Linda Vardy pled guilty to a misdemeanor charge of commercial fishing in closed waters and was fined $5,000 with zero suspended. Previously a third defendant, John R. Lane, 26, of California, pled guilty to a single charge of hindering prosecution. This case was initiated in July 2010 after a wildlife trooper on aircraft patrol of the Egegik commercial fishing district observed the F/V High Octane fishing in closed waters. Lane, at Tim Vardy's direction, used his body to attempt to obscure the vessel's Alaska Department of Fish and Game numbers to prevent identification and prosecution. Tim Vardy, the skipper and one of two permit holders, used a jacket to obscure the other ADF&G number.

Troopers say crew tried to conceal boat identity

Type: Commercial fish closed waters, hindering prosecution
On 7/22/10 at 1620 hours, Alaska Wildlife Troopers on aircraft patrol documented the F/V High Octane commercial fishing in closed waters 0.1 nautical mile north of the Egegik District north boundary line. While attempting to document the violation and identity of the vessel the skipper, later identified as Tim Allen Vardy, 55, of Lakewood, Wash., and a crewmember, later identified as John R. Lane of Morro Bay, Calif., attempted to conceal the identity of the vessel by covering its Alaska Department of Fish and Game numbers with their bodies and a coat. On 7/28/10 Alaska Wildlife Troopers located and contacted the F/V High Octane in the Naknek River and issued the following citations: Tim Allen Vardy, commercial fishing in closed waters, hindering prosecution and failure to properly display vessel numbers; Linda Sue Vardy, 47, of Lakewood, Wash., commercial fishing in closed waters; and John R. Lane, hindering prosecution. Arraignments for all persons is set for 8/20/10 in Naknek District Court.

On 7/28/10 King Salmon Alaska Wildlife Troopers cited Vincent E. Hoiby, 47, of Everett, Wash., for commercial fishing on 7/24/10 in closed waters 500 feet north of the Egegik District north boundary aboard the F/V Jesse N. Arraignment is set for 8/20/10 in Naknek District Court.
